How Accurate Are Breathalyzer Tests? What a DUI Breath Test Really Tells You

A DUI breath test may produce a number to three decimal places, but precision on a screen is not the same thing as unquestionable accuracy. Understanding the result requires understanding how it was obtained.

The Short Answer

A DUI breath test can produce a result to three decimal places.

That level of precision can make the number seem absolute.

0.082. 0.146. 0.203.

But what exactly did the instrument measure? How was the sample collected? Was the instrument functioning properly? Were required procedures followed? And how closely does a breath alcohol result answer the question everyone actually cares about: how much alcohol was affecting the driver?

Those questions are why the better question is not simply, “Are breathalyzers accurate?”

It is:

How reliable is this particular breath test, obtained from this particular person, under these particular circumstances?

Terminology

Not Every "Breathalyzer" Is the Same Thing

The word breathalyzer is commonly used to describe almost any device that measures alcohol in breath.

In DUI investigations, however, an important distinction exists between a preliminary breath test (PBT) and an evidential breath test.

A PBT is generally a handheld roadside screening device. Officers may use it as one part of the pre-arrest investigation.

An evidential breath-testing instrument is designed and approved for evidentiary alcohol testing and is generally subject to more formal procedures, quality-control requirements, instrument checks, and documentation.

That distinction matters.

A number obtained from a handheld roadside device should not automatically be treated as interchangeable with a result obtained through a state's evidential breath-testing program.

The Measurement

What Does a Breath Test Actually Measure?

A breath-testing instrument does not insert a sensor into the bloodstream.

It analyzes alcohol in a breath sample.

Alcohol circulating in the body can pass from the blood into air within the lungs. Breath-testing systems use the alcohol detected in exhaled breath to determine a breath alcohol concentration.

In many jurisdictions, breath alcohol is expressed in grams of alcohol per 210 liters of breath.

That is different from directly measuring alcohol in a blood specimen.

This distinction is often lost when every alcohol result is casually called a "BAC."

Blood and breath measurements are related, but they are not literally the same measurement.

Sample Collection

Why the Breath Sample Matters

An instrument can only analyze the sample it receives.

For evidential breath testing, the goal is generally to obtain a sample representative of deep-lung or end-expiratory breath rather than alcohol contamination from the mouth.

That is one reason many breath-testing protocols include some form of observation or deprivation period before evidential testing.

The exact requirements vary by jurisdiction and testing program.

The concern is straightforward: recently consumed alcohol, regurgitation, vomiting, or other sources of alcohol remaining in the mouth can potentially affect a breath sample.

This issue is commonly referred to as mouth alcohol.

Modern evidential instruments may incorporate safeguards designed to identify certain abnormal sample patterns, but proper collection procedures still matter.

Beyond the Instrument

Instrument Accuracy Is Only One Part of Reliability

When someone asks whether a breathalyzer is accurate, they are often thinking exclusively about the machine.

But DUI breath-test reliability involves more than the analytical instrument itself.

A meaningful review may consider:

  • Whether the instrument was approved for evidential use
  • Whether required accuracy or calibration checks were current
  • Whether required quality-assurance procedures were followed
  • Whether the operator was properly qualified
  • Whether an appropriate observation or deprivation period occurred
  • Whether the breath samples met the program's acceptance criteria
  • Whether duplicate samples were sufficiently consistent
  • Whether the instrument generated error or status messages
  • Whether the test record is complete
  • Whether environmental or sample-related issues were identified

The specific requirements vary significantly between states and breath-testing programs.

That is why a generic statement that "breathalyzers are accurate" or "breathalyzers are unreliable" is rarely useful.

The actual test has to be evaluated.

Consistency

Two Similar Breath Samples Can Be Important

Many evidential breath-testing programs obtain more than one subject sample.

Why?

Consistency provides useful information.

If two independently collected breath samples are reasonably close to one another, that can support the reproducibility of the result.

If they are not, the testing program may have rules governing whether the test is accepted, rejected, repeated, or otherwise evaluated.

The exact agreement criteria are jurisdiction-specific.

A DUI review should therefore look beyond the final number quoted in the police report and examine the underlying breath-test ticket or data record.

Timing

Timing Can Matter Just as Much as the Machine

Suppose someone stops driving at 11:00 p.m. and provides an evidential breath sample at 12:30 a.m.

The instrument may accurately report the person's breath alcohol concentration at 12:30 a.m.

That does not automatically establish the person's alcohol concentration at 11:00 p.m.

Alcohol concentration changes over time.

Depending on when alcohol was consumed, food intake, absorption, and individual physiology, a person's alcohol concentration may have been rising, near a peak, or declining during the period between driving and testing.

This is where concepts such as alcohol absorption, elimination, and retrograde extrapolation may become relevant.

Timing does not automatically undermine a breath result.

But a later chemical test and the person's alcohol concentration at the time of driving are not necessarily identical questions.

High Results

What About a Very High Breath-Test Result?

A high numerical result is obviously important evidence.

But the same basic review still applies.

A high number should not cause investigators, attorneys, or experts to stop asking whether:

  • The test was properly administered
  • The samples were accepted correctly
  • The instrument records support the reported result
  • The timeline makes sense
  • The person's presentation is consistent or inconsistent with the alleged concentration
  • Video evidence provides additional context

This does not mean a person must "look drunk" for a high result to be accurate.

Tolerance, behavior, circumstances, and individual presentation vary.

It simply means the chemical evidence should be evaluated as evidence, not treated as immune from review because the number is large.

Error Sources

Can a Breathalyzer Be Wrong?

Yes, a breath-test result can be affected by problems.

But that does not mean breath testing is inherently unreliable.

Potential issues can include collection problems, mouth alcohol, procedural deviations, instrument-related problems, incomplete maintenance documentation, sample inconsistency, or errors in how the result is interpreted.

The important question is whether any such issue actually occurred in the case being reviewed and whether it could meaningfully affect the result.

Finding a technical deviation is not the same thing as proving the reported alcohol concentration is wrong.

Likewise, the absence of an obvious error message does not eliminate the need to review how the test was obtained.

Case Review

What Should Be Reviewed in a DUI Breath-Test Case?

A complete breath-test review may include:

  • Police reports
  • Breath-test printouts
  • Instrument records
  • Accuracy and quality-assurance documentation
  • Operator information
  • Observation-period documentation
  • Body-worn camera
  • Booking-room video
  • Dash-camera footage
  • Statements regarding drinking
  • The timeline between driving and testing
  • Prior or subsequent PBT results
  • The consistency of duplicate samples

The breath result is one piece of a much larger timeline.

This kind of review often overlaps with Standardized Field Sobriety Test evidence and, in below-threshold or borderline cases, with the question of whether a DUI can be pursued under .08.

The Bottom Line

What a Breath Result Actually Establishes

Breath-testing technology can produce valuable and scientifically meaningful evidence.

But a result should not be evaluated solely because a machine printed three digits after a decimal point.

The more useful questions are:

What type of breath test was used?

Was the test administered according to the applicable procedure?

Did the instrument and samples satisfy required criteria?

Does the underlying data support the reported result?

And what does that result actually establish about the person at the time of driving?
