Everyone knows .08 is associated with DUI. Fewer people understand what the number actually represents, how blood and breath measurements differ, or what a result can, and cannot, prove.

The Short Answer

Few numbers are as closely associated with DUI as:

.08

It appears in advertisements, driver's education courses, news reports, statutes, police reports, and courtroom testimony.

But what exactly is .08?

Is it a percentage?

Does a person instantly become impaired when the number changes from .079 to .080?

Does a breath test showing .08 mean the person's blood literally contained that exact concentration?

And what does a result obtained an hour after driving tell us about the earlier time behind the wheel?

Understanding .08 requires separating several related concepts.

Blood

BAC Usually Means Blood Alcohol Concentration

BAC commonly means blood alcohol concentration.

In a blood test, alcohol concentration is often reported as grams of alcohol per deciliter of blood.

A result of .08 g/dL means approximately 0.08 grams of alcohol per deciliter of blood.

That is a concentration, not a count of drinks and not a direct measurement of how impaired someone appears.

Breath

Breath Alcohol Uses a Different Measurement

A DUI breath-testing instrument analyzes breath rather than blood.

Breath alcohol concentration is commonly expressed as grams of alcohol per 210 liters of breath.

Because the familiar numerical thresholds are often similar, people routinely refer to a breath result as "BAC."

In casual conversation that may be understandable.

For forensic purposes, however, it is useful to recognize that:

Blood alcohol and breath alcohol are different measurements obtained from different specimens.

Why Is .08 Important?

Most U.S. jurisdictions use a defined alcohol concentration to establish a per-se impaired-driving offense for ordinary adult drivers.

The specific threshold and legal rules can vary depending on jurisdiction and driver category.

A per-se law generally means the prosecution does not need to prove impairment in exactly the same manner once the prohibited alcohol concentration is established under the applicable statute.

But that is a legal rule.

It should not be confused with the idea that human impairment begins at exactly the same numerical point for every person.

Nuance

.079 and .080 Are Not Different Biological Universes

The human body does not recognize statutory decimal points.

Alcohol can affect driving-related abilities below a per-se threshold.

Likewise, the precise degree of observable impairment at a given concentration can vary.

That is why the statement:

"Under .08 means unimpaired"

is too broad.

But the opposite statement:

"Any detectable alcohol means impaired"

is also too broad.

Variability

How Many Drinks Equal .08?

There is no universally accurate answer.

Alcohol concentration can be influenced by numerous variables, including:

  • Time since the last drink
  • Individual physiology

Charts estimating how many drinks will produce a particular concentration are therefore approximations.

BAC Changes Over Time

Alcohol concentration is dynamic.

After drinking, alcohol is absorbed into the bloodstream.

Eventually the person reaches a peak concentration.

After absorption is substantially complete, elimination becomes the dominant process and the alcohol concentration declines.

That timeline becomes extremely important in DUI cases.

Suppose someone drives at 10:30 p.m. and provides a breath sample at midnight.

The midnight result is not a direct measurement taken at 10:30.

The person's concentration at the earlier time depends partly on what phase of the alcohol curve they were in.

Rising BAC

If a person consumed alcohol shortly before driving, the alcohol concentration may still have been rising.

In that scenario, a later breath or blood result could potentially be higher than the concentration at the time of driving.

That possibility is sometimes described as a rising BAC issue.

Whether it is scientifically reasonable in a particular case depends on the drinking timeline and available evidence.

Falling BAC

If alcohol had already been fully absorbed, the person's concentration may have been declining.

In that situation, the alcohol concentration at the earlier time of driving could have been higher than the later test result.

That is why retrograde extrapolation sometimes appears in DUI cases.

But calculating backward requires assumptions.

The reliability of the conclusion depends on the quality of the underlying information.

Measurement

Is .08 a Perfect Measurement?

No analytical measurement should be interpreted without understanding how it was obtained.

Breath and blood testing both involve quality-control procedures and measurement considerations.

Depending on the method, a review may involve:

  • Instrument accuracy
  • Calibration or verification
  • Analytical uncertainty
  • Sample consistency
  • Collection procedures
  • Laboratory procedures
  • Timing
  • Documentation

The existence of measurement uncertainty does not mean the result is meaningless.

It means scientific measurements should be understood as measurements, not magical exact values detached from the testing process.

Beyond the Number

Does a .08 Result Prove Impairment?

A result at or above the applicable statutory threshold can have major legal significance.

But the word impairment can be used in different ways.

There is the legal significance of reaching a prohibited alcohol concentration.

There is also the broader forensic question of what impairment was actually observable in the person's driving, cognition, coordination, judgment, and divided attention.

  • Blood testing

A chemical result should fit into that evidence rather than replace it.
